O R D E R
The prayer of the petitioners in this case is as under: 'For the reasons stated in the accompanying affidavit the petitioners pray that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents 3 and 4 in repeatedly insisting the petitioners to appear before their authority and settle to the terms of 5th respondent as illegal, irregular, irrational, without any authority of law and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents not to interfere in any manner with the petitioners' possession over their landed property of Ac. 1.50 cents in D. No. 102/A of Tangellamudi Village in Peddakakani Mandal of Guntur District and also personal liberty of the petitioners and pass such other orders or order as this Hon'ble Court may deem fit and proper in the circumstances of the case.'
The Station House Officer, Chebrolu Police Station, Guntur Urban District, furnished written instructions dated 04.04.2016 to the office of the learned Government Pleader for Home, wherein he stated that Chebrolu police never called the petitioner to the police station. It appears that the petitioner himself gave a statement to that effect in writing to the police authorities and the same is also placed on record. In the light of the aforestated stand of the police authorities which is duly taken on record, no adjudication is warranted on merits in this writ petition.
Sri K.Anil, learned counsel representing Sri Nimmagadda Satyanarayana, learned counsel for the petitioners, is also agreeable to closure of this case recording the stand of the police authorities. The writ petition is accordingly closed. Pending miscellaneous petitions shall also stand closed in the light of this final order. No order as to costs.
