THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N. BALAYOGI WRI T PETI TI ON Nos.687 and 31094 of 2016 COMMON ORDER: (Per Justice Sanjay Kumar) These two writ petitions were filed assailing the orders passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.SR.No.15429 of 2014 and O.A.No.1609 of 2014 respectively. The matter relates to reservation in public employment under Sports quota. G.O.Ms.No.84 dated 04.05.2000 was promulgated by the Government of Andhra Pradesh extending 2% Sports reservation in future direct recruitment in the Government at all levels. This policy decision was sought to be given effect to under the guidelines formulated by the Government of Andhra Pradesh under G.O.Ms.No.74 dated 09.08.2012. The petitioners, who are both sports persons, seek benefit of this reservation policy in relation to the recruitment undertaken to the posts of Village Revenue Officers vide notification dated 28.12.2013. The Tribunal held against them and dismissed their O.As.

Sri P. Suresh Reddy, learned senior counsel representing Sri M. Krishna Rao, learned counsel for the petitioners in these two cases, having argued for some time, brought it to the notice of this Court that the representation dated 07.10.2014 made by the petitioners to the District Collector, Srikakulam, is still awaiting consideration. He would therefore submit that it would suffice at this stage if the District Collector, Srikakulam, considers the said representation and takes appropriate action thereon.

Perusal of the said representation reflects that the petitioners requested that their cases may be considered on humanitarian grounds as they were yet to cross the age limit as on that date. In the light of the submission made by the learned senior counsel, the writ petitions are disposed of permitting the petitioners to pursue the representation made by them on 07.10.2014. It is possible that a copy of the said representation may not be available with the authorities at this late stage. The petitioners are therefore permitted to furnish a copy of the said representation along with supporting material, if any, to the District Collector, Srikakulam, who shall consider the same on its own merits and in accordance with law and communicate the decision taken to the petitioners. This exercise shall be completed expeditiously and, in any event, not later than eight weeks from the date of receipt of a copy of the representation.
