THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.36789 of 2016 O R D E R:

Pursuant to the notice dated 16.09.2016, issued by the 3rd respondent alleging violations and making constructions in violation of the sanctioned plan, petitioner submitted a detailed representation on 18.06.2016. It is the grievance of the petitioners that the respondents even without passing any orders on the representation submitted by the petitioners in terms of the provisions of the H.M.D.A Act, 2008 and Rules made thereunder, the respondents are threatening the petitioners for demolition of the farm house constructions in Sy.No.585/A/3, Bibinagar Village and Mandal, Nalgonda District.

Inasmuch as no orders are passed by the respondents so far on the representation dated 18.06.2016 submitted by the petitioners, the writ petition is disposed of with a direction to the respondents not to interfere or not to take any coercive steps with respect to the petitioners' properties unless and until the orders are passed on the representation dated 18.06.2016 after giving the reasonable opportunity to the petitioners, in accordance with law. It is also made clear that the petitioners shall not make any further constructions. However, the learned standing counsel shall inform the respondents about the passing of the orders. There shall be no order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
