THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11905 OF 2018 ORDER:

This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused, for grant of bail in Crime No.145 of 2018 of I Town Police Station, Chittoor District, registered for the offences punishable under Sections 420 and 376 of IPC.

Heard the learned counsel for the petitioner/accused and the learned Additional Public Prosecutor representing the respondent-State and perused the record.

The learned counsel for the petitioner/accused would contend that the petitioner is falsely implicated in this case. No forcible sexual act was committed against the victim and ultimately, prayed to allow the petition.

The learned Additional Public Prosecutor opposed the grant of bail to the petitioner/accused and ultimately, prayed to dismiss the petition.

During the course of investigation into the allegations made in the FIR, it has come to light that the petitioner/accused had forcible sexual intercourse with the victim under the guise of love and marriage. The offences alleged to have been committed are heinous in nature. There is stringent punishment for the said offences. Release of the petitioner on bail would hinder the investigation. There is possibility of threatening the witnesses also. There are no justifiable grounds to allow the petition.
