THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.20299 of 2016 ORDER:
Heard learned counsel appearing for both parties. With the consent of counsel appearing for both sides, the present Writ Petition is disposed of at the admission stage.
2. The present Writ Petition came to be filed with the following prayer: "to issue a Writ, order or direction, more particularly a Writ in the nature of MANDAMUS declaring the action of the 2nd respondent in not considering and passing orders in Appeal No. of 2016 dated 2-1-2016 filed against orders in Letter No.G1/269/201 5 dated 4-12-2015 passed by the Commissioner, Municipality, Mancherial as illegal, arbitrary and colorable exercise of power and pass such other order or orders as the Honourable Court may deem fit and proper."
3. Though various grounds raised in the Writ Petition, learned counsel for the petitioners restricts his prayer seeking a direction to the 2nd respondent- Municipal Council, Mancherial, Adilabad District, to consider the appeal filed by petitioners. Learned Standing Counsel for respondent No.2 stated no objection for the same.
4. Having regard to the above and without going into the merits of the case, the Writ Petition is disposed of directing the 2nd respondent to dispose of the appeal filed by the petitioners on 02.01.2016 pursuant to the letter, dated 04.12.2015, issued by respondent No.2, in accordance with law, as early as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
