HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.40793 OF 2018 ORDER:

1) Heard learned counsel for the petitioners and learned Government Pleader for Revenue. With their consent, the writ petition is disposed of at the admission stage.

2) This writ petition came to be filed seeking issuance of writ of mandamus declaring the impugned notice dated 11.05.2018, issued by the 3rd respondent in respect of the subject water plants, as illegal and arbitrary.

3) Though various grounds are raised, learned counsel for the petitioners submits that without giving an opportunity of submitting explanation or explaining their stand, the impugned notice came to be issued ordering stoppage of water plants.

4) The learned Standing Counsel would submit that treating the notice dated 11.05.2018 as show cause notice, the petitioners may submit their explanation, in which event, the authorities would deal with the same, in accordance with law.

5) Having regard to the above circumstances, the writ petition is disposed by directing the petitioners to submit their explanations by treating the notice dated 11.05.2018 as show cause notice, enclosing necessary documents, in which event, the authorities concerned shall pass orders, in accordance with law, after hearing all the concerned. Till such time, status-quo existing as on today, to be maintained with regard to the subject plants.
