2018-11-12A.Rajasheker Reddy2 pages

HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.40393 of 2018 ORDER:

The case of the petitioners is that they are the residents of Satyalapadu Village. They made applications for construction of houses in the year 2004 and 2005 and that the Government issued house sites which were allotted in R.S.No.113/6A and 114/2 situated at Satyalapadu village, Gampalagudem Mandal, Krishna District to the petitioners for construction of houses by order dated 22-04-2004. But till now the plots have not been demarcated and not handed over to the petitioners. On that the petitioners made a representation on 08-08-2018 to demarcate the boundaries and hand over the plots to them to construct houses.

But no action has been taken on the said representation. It is also the case of the petitioners that the respondents issued new list dated 12-04-2018 instead of old list dated 22-04-2004 without giving any notice to the petitioners and without cancelling the pattas issued to them. Heard both sides.

It is to be seen that the grievance of the petitioners is already pending before the 4th respondent, the 4th respondent is directed to consider the representation dated 08-08-2018 made by the petitioners and take action in accordance with law. More so, as long as the pattas issued to the petitioners are valid and

subsisting, the subject land cannot be allotted to any other persons.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
