HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.419 of 2016 ORDER:

This criminal petition, under Section 438 Cr.P.C., is filed by petitioner/A.2 in Cr.No.324 of 2015 of ACP WCO Team-II, CCS, Hyderabad, registered for the offences punishable under Sections 120-B, 302 read with 34 IPC.

2. Heard.

3. It is alleged that on 26.12.2015, A.4 to A.6 attacked the deceased and killed him. According to the prosecution, A.1 to A.6 conspired and caused the death of the deceased in view of the civil disputes. It is submitted by the learned counsel for the petitioner/A.2 that A.1 and A.3 engaged A.4 to A.6 to kill the deceased. Even as per the remand report, there are no allegations against the petitioner/A.2.

4. The investigation discloses that it is A.2, who is the prime accused in the alleged offence. Further, except petitioner/A.2, other accused had already been arrested and remanded to judicial custody. In view of the same, it is not a fit case to extend the relief of granting anticipatory bail to the petitioner/A.2. There are no merits in the case.
