THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.36066 of 2017 ORDER:
Petitioner's grievance is that he made a representation on 09.10.2017 to the 2nd respondent seeking to continue his wine shop in survey No.623 of Varagali Village, Chillakuru Mandal, SPSR Nellore District for a period of 20 months on payment of rents, but the 2nd respondent has not passed any orders thereon till date.

Petitioner contends that the land in said survey number belongs to the State and no prejudice would be caused to the State, if the petitioner is allowed to continue his retail business in liquor therein.

The Government Pleader for Revenue appearing for respondents 1 to 4 states that the 2nd respondent will consider the petitioner's representation dt.09.10.2017 within a period of one week from the date of receipt of a copy of this order and communicate his decision to the petitioner.

The Government Pleader for Prohibition and Excise appearing for 5th respondent pointed out that the petitioner approached this Court in W.P.No.26803 of 2017, that this Court by order dt.09.08.2017 permitted the petitioner to continue his business in the said survey number only up to
31.10.2017, that the petitioner had even filed undertaking that he would vacate the said premises by 31.10.2017, and therefore, petitioner is not entitled to seek any continuation in the land in said survey number for any further period. 5.
In this view of the matter, the 2nd respondent is directed to consider petitioner's representation dt.09.10.2017 within one (1) week from the date of receipt of a copy of this order and communicate his decision to the petitioner.

Accordingly, this Writ Petition is disposed of. No costs. 7.
Consequently, miscellaneous petitions pending if any shall stand closed.
