THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY I.A.No. 1 OF 2018 IN/AND CRIMINAL PETITION NO. 16255 OF 2016 COMMON ORDER:
I.A.No. 1 is filed under Section 320 (2) of Cr.P.C. to record compromise in C.C.No. 390 of 2016 on the file of the Court of learned Additional Judicial I Class Magistrate at Sangareddy, Medak District, registered for the offences punishable under Section 498-A of IPC and Sections 3 and 4 of Dowry Prohibition Act.
Both parties are personally present and they are identified by their respective counsel and produced Photostat copies of Aadhaar Cards in proof of their identity. On enquiry, it is stated that petitioner No. 1-accused No. 1 and respondent No. 2-de facto complainant obtained KHULA DIVORCE; that the former paid Rs.2,00,000/ - to the latter towards full and final settlement; that there is no subsisting marital relationship between them; that they intend to lead peaceful life at least in future and that therefore they have entered into compromise and the compromise is voluntary in the interest of both parties and not against the societal interest.
In the light of the above, I.A.No. 1 of 2018 is allowed permitting both parties to compound the said offences and to record compromise.
In view of the orders passed in I.A.No. 1 of 2018, this Criminal Petition is allowed quashing the proceedings in C.C.No. 390 of 2016 on the file of the Court of learned Additional Judicial I Class Magistrate at Sangareddy, Medak District. Pending miscellaneous petitions, if any, shall stand closed in consequence. The Registry is directed to annex a copy of the joint memo to this order.
