Aggrieved by the order of the Revenue Divisional Officer dated 17.07.2017 cancelling the pattadar passbook issued in favour of the petitioner and directing correction in the revenue records, petitioner filed revision before the Joint Collector. Along with the revision, stay petition is also filed. Alleging inaction in passing orders on the revision or in the stay petition, this Writ Petition is filed.

Learned counsel for the petitioner contends that the stay petition is pending, and since no orders are passed, the authorities are taking steps to cancel the pattadar passbook and title deeds, correct the revenue records and issue pattadar passbook and title deeds in favour of unofficial respondents 5 and 6. 4.

Having regard to these submissions, without expressing any opinion on the merits of the case and without affecting the rights and defense of respondents 5 and 6, the Writ Petition is disposed of directing the Joint Collector to consider the revision filed by the petitioner, after affording due opportunity to him as well as unofficial respondents, and pass appropriate orders as expeditiously as possible preferably within a period of three months from the date of receipt of a copy of this order. The Joint Collector is further directed to consider the prayer of the petitioner

to grant interim stay after affording due opportunity to both the parties within a period of two weeks from the date of receipt of a copy of this order. Till stay application is considered and appropriate orders are passed by the Joint Collector, the position as on today with reference to entry in the revenue records shall be maintained. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in the Writ Petition shall stand closed.
