THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.NO.10665 OF 2016

O R D E R

This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.26/2015 on the file of Additional Judicial First class Magistrate at Bhongir, registered against the petitioners/accused 2 to 5 for the alleged offences punishable under Sections 498-A and 417 IPC and Sections 3 and 4 of Dowry Prohibition Act. Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the State.

A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, within a period of three months from the date of receipt of a copy of this order, without insisting the presence of the petitioners/accused 3 to 5, unless required for any specific purpose. The 1st petitioner / A-2 shall appear before the court below during the course of trial.

Miscellaneous petitions pending if any, shall stand closed. No costs. ------------------------------ M.S.K.JAISWAL,J DATE:22.07.2016 AVS
