HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 0 4 3 5 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Chandanagar Police Station, dated 28.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "On a complaint of Varanasi Bhagavath, son of late Sankaraiah, aged 72 years/ 5th respondent herein lodged with the police of Chandranagar Police Station, a case in Cr.No.524/ 2018 under Section Cr.P.C., dated 22.08.2018 was registered as the daughter of the complainant by name Swetha committed suicide by hanging due to not blessing of children and taken up the investigation into the case.
During the course of investigation, this respondent being the Investigating Officer examined the complainant/ 5th respondent herein and other witnesses and recorded their detailed statements.
A suicide note was also recovered from the possession of the deceased.
Basing on the statements of the witnesses, Section of Law was altered from Section 174 Cr.P.C., to Sections 498-A I.P.C. and Section 306 I.P.C. and taken up the investigation into the case.
It is respectfully submitted that the investigation is under progress. No clues are forthcoming about the involvement of the petitioner in the commission of offences punishable under Sections 498-A and 306 I.P.C. If any clues are forthcoming about the involvement or petitioner who is the father of the accused A.1-Neeli Praveen Kumar and A.2Neeli Anasuya, wife of the petitioner herein, certainly action will be taken against him by following the due procedure.
It is humbly submitted that to divert the attention of the investigating agency in not conducting the
investigation into the case in a proper and fair manner, the petitioner filed the present Writ Petition with false and frivolous allegations.
It is humbly submitted that at any point of time, this respondent police interfered with the life and liberty of the petitioner herein.
It is pertinent to submit that the son of the petitioner and wife of the petitioner are absconding after alteration of the Section of law in the above case. I humbly submit that the petitioner pretty known the whereabouts of his son and wife but to divert the attention of the investigating agency in not conducting the investigation into the case in a fair and proper manner, filed the present Writ Petition."
Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Chandanagar Police Station, dated 28.11.2018, with a further direction to the respondent-police authorities to act strictly in accordance with law.
