THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3127 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 seeking to set aside the order, dated 29.2.2016, in Crl.M.P.No.361 of 2016 in C.C.No.614 of 2015 on the file of XIII Metropolitan Magistrate, Cyberabad at L.B.Nagar and consequently, to set aside the Lookout Circular issued by the Commissioner of Police, Cyberabad, Ranga Reddy District on the recommendation of the Sub Inspector of Police, Nacharam Police Station against the petitioner in Crime No.236 of 2015, which was subsequently numbered as C.C.No.614 of 2015.

2. Heard and perused the material available on record.

3. The offences alleged against the petitioner/A-1 are punishable under Sections 420 and 498-A I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

4. Petitioner herein has filed Crl.M.P.No.361 of 2016 before the trial Court praying to withdraw the Lookout Circular issued against him by the Commissioner of Police, Cyberabad and the same was dismissed on the ground that if the petitioner is permitted to go abroad, the trial could not be proceeded with.

5. Considering the facts and circumstances of the case, this Court is of the view that the case can be proceeded with in the absence of the petitioner since the parents of the petitioner are also accused in the same case. Therefore, the petitioner is permitted to go abroad and he is directed to engage a counsel to represent his case before the trial Court. Further, the petitioner is directed to appear before the trial Court for the purpose of trial whenever insisted.
