THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.11680 of 2016 ORDER:

The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in Cr.No.57 of 2016 of Airport P.S., Visakhapatnam City, registered for the offences punishable under Section 498-A IPC and under sections 3 & 4 of Dowry Prohibition Act.

Heard the learned counsel appearing for the petitioners/A1 to A7 and the learned Additional Public Prosecutor, representing the State. Specific allegations were made in the charge sheet against the petitioners. The truth or otherwise of the allegations can only be decided during course of investigation. I see no ground to quash the first information report.

The learned counsel for the petitioners submitted that A1 was arrested, remanded and released on bail, and A2 to A7 were granted relief under Section 41-A Cr.P.C by the jurisdictional police and all of them are residents of Hyderabad, however, the concerned police are insisting for their appearance now and then causing them inconvenience. In view of the above, the Criminal Petition is disposed of, directing the Investigating Agency to proceed with the investigation, without insisting for the presence of the petitioners/A1 to A7, unless it feels that their physical presence is necessary for any specific purpose during course of investigation.

Pending miscellaneous applications, if any, shall stand closed in consequence.
