Bollipalli Himavathi, v. The State Of Andhra Pradesh,
Date: 27.10.2017 Between:
Bollipalli Himavathi, W/o B.Devarajulu Naidu, Aged 56 years, occu: Housewife, R/o Door No.4-99, Sakamvaripalle, Manchuru post, Vyalpadu Mandal, Chittoor district and others.
.... Petitioners And The State of Andhra Pradesh, rep., by the Commissioner and Inspector General of Registration & Stamps, Hyderabad, A.P., and others.
.... Respondents The Court made the following:
ORDER:
Heard learned counsel for petitioners and learned Government Pleader for Revenue (AP) for respondents. 2.
Petitioners claim to be the absolute owners and in possession of agricultural land to an extent of Ac.49.50 cents in Sy.Nos.258, 261, 262, 269, 270 and 271 of Sakamvaripalle village, Manchuru Revenue village, Vyalpadu mandal, Chittoor district. Grievance of the petitioners is that for their family necessities they intend to dispose of the said property and when they approached the Sub-Registrar to receive the deed of conveyance, the SubRegistrar refused to receive the same on the ground that in the revenue records said property is reflected as ' dotted lands' and, therefore, cannot be registered.
3.
Though 'dotted lands' in the revenue records are treated as Government property earlier, the State of Andhra Pradesh enacted 'the Andhra Pradesh Dotted Lands (Updated in Resettlement Register) Act, 2017' (Act, 2017). Taking advantage of the said enactment, petitioners claimed to have submitted application on 09.07.2017 for removing the description of 'dotted lands' from the revenue records in respect of the subject property. Alleging inaction on said representation and action by the registering authority in not accepting the documents, this writ petition is filed. 4.
Petitioners enclosed the copy of receipt issued on AP Online in proof of submission of application under the Act. In view of the same, writ petition is disposed of, without expressing any opinion
on merits, directing the District Level Committee, headed by the District Collector, Chittoor district to consider the grievance of the petitioners for correction of revenue records in accordance with the provisions of the Act, 2017 and decision thereon shall be taken and communicate the same to the petitioners, by assigning due reasons in support of its decision, within a period of six weeks from the date of receipt of a copy of this order. If the District Level Committee is in agreement with the claim of petitioners, appropriate decision shall also be communicated to the Registration Department for deleting the subject property from the prohibited list of properties.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. ___________________________ JUSTICE P.NAVEEN RAO Date: 27.10.2017 kkm
