T.Ramchander, v. The State Of Telangana, Rep By Its Principal Secretary To
THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N.BALAYOGI WRI T PETI TI ON No.20139 of 2016 ORDER: (per SK,J) The petitioners are the applicants in O.A.SR.No.2564 of 2016 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. They filed M.A.No.497 of 2016 therein seeking permission to file a common O.A. by paying individual Court fee. By order dated 30.03.2016, the Tribunal held that there could be no common cause of action as the particulars of each of the petitioners and their claims against the respondents differed. The Tribunal therefore held that a single O.A. could not be permitted to be filed by all of them and dismissed the miscellaneous application. Aggrieved thereby, they filed the present writ petition on 21.06.2016.
While so, the Tribunal stood abolished in so far as the State of Telangana is concerned during September, 2016. That being so, the question of the petitioners approaching the Tribunal for redressal of their grievance does not survive at this stage.
The writ petition is accordingly dismissed leaving it open to the petitioners to avail appropriate remedies in relation to the grievance sought to be canvassed by them before the Tribunal in accordance with law before the proper forum.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
