HONOURABLE SRI JUSTICE CHALLA KODANDA RAM W.P.No.21352 of 2016 ORDER:

This writ petition is filed seeking to declare the action of respondents in proposing to demolish the houses of the petitioners bearing D.Nos.1-83 and 1respectively, Main Veedhi, Runku Hanumanthupuram Village, Santhabommali Mandal, Srikakulam District, as arbitrary and illegal. Petitioners are the absolute owners and possessors of the said houses. After obtaining permission from the Gram Panchayat, they have constructed the houses and they have been in possession and enjoyment of the same. While so, the respondent-authorities are trying to demolish the front portion of their houses for road widening purpose.

The grievance of the petitioners is that without issuing any notice or affording an opportunity, the respondent-authorities are trying to interfere with their peaceful possession.

In view of the above, the respondentauthorities are directed not to interfere with the peaceful possession and enjoyment of the subject property by the petitioners, including demolition, except in accordance with the due procedure laid

down by law.

Writ Petition is accordingly disposed of. No costs.

Miscellaneous petitions pending, if any, shall stand closed.
