THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11940 OF 2018 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused, for grant of bail in Crime No.187 of 2015 of V Town Police Station, Nellore, registered for the offences punishable under Sections 420, 380, 467 and 468 of IPC.

Heard the learned counsel for the petitioner/accused and the learned Additional Public Prosecutor representing the respondent-State and perused the record.

Learned counsel for the petitioner/accused would submit that this petition is filed after the lapse of three years. The earlier bail petition was dismissed by this Court. Most part of the investigation is completed and ultimately, prayed to allow the petition.

Learned Additional Public Prosecutor opposed the grant of bail to the petitioner/accused.

The allegations against the petitioner/accused are that he forged the signatures of the officer working in Government Hospital, Nellore and withdrew Rs.46,000/- on 17.04.2015 and when an attempt was made to withdraw Rs.66 lakhs, the bankers got a doubt. In the course of enquiry with the employees concerned of the hospital, it came to light that the cheque produced to withdraw Rs.66 lakhs was a forged one. There are allegations against the petitioner showing his active role in the alleged offences. Moreover, earlier bail application of the petitioner was dismissed by this Court. The allegations are grave. The gravity of offence is high. The release
of petitioner would threaten the witnesses. It is not a fit case to allow the petition under Section 438 Cr.P.C.
