THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.38500 OF 2017 ORDER:

Heard counsel for the petitioners and the Government Pleader for Assignment for respondent Nos.1 to 4.

2. Petitioners assail the notices dt. 08.11.2017 issued under Section 7 of the A.P. Land Encroachment Act, 1905, contending that they have been given Possession Certificates to occupy portions of land in Survey No.259, but the revenue authorities mislead them and inducted them into possession of land in Survey No.258 and now the 4th respondent is taking action to evict them. It is also contended that the notices, in fact, were not served personally on them, but they were pasted elsewhere.

3. Government Pleader for Assignment appearing for respondent Nos.1 to 4 states that the petitioners are at liberty to give explanation to the show-cause notices and then the 4th respondent will consider the same and pass appropriate orders.

4. Accordingly, the Writ Petition is disposed of directing the petitioners to submit explanation to the show-cause notices dt. 08.11.2017 issued to them within a period of four weeks from the date of receipt of a copy of this order and on receiving the explanation, the 4th respondent is directed to pass appropriate orders in accordance with law and communicate the same to the petitioners. Till

the orders passed by the 4th respondent are communicated to the petitioners and for a period of two weeks thereafter, execution of any such order, which is adverse to the petitioners, shall not be taken out. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. ____________________________ M.S.RAMACHANDRA RAO, J November 15, 2017.
