HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.40449 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Forest.

2) The present writ petition came to be filed declaring the action of the respondents in issuing impugned e-procurement tender notification vide tender ID No.90359 and tender notice No.80/2016/A3, dated 05.11.2018, for supply of polythene bags issued by respondent No.4, as illegal and arbitrary, when the agreement entered into by the respondents and the petitioners is still in force. 3) It is stated that respondent No.4, invited tenders in the month of November, 2017 for supply of polythene bags to which the petitioners and others submitted their tenders for supply of polythene bags for a period of one year starting from January 2018 to 2019. While the agreement is still in force, the e-procurement tender notification is said to have been issued, and the same is challenged in the present writ petition.

4) Learned Government Pleader for Forests would submit that the process which the respondents are undertaking would be for the period commencing after January, 2019

and that they are not interfering with the supply of polythene bags by the petitioner.

5) Recording the statement made by the learned Government Pleader for Forests and in view of the statement made that the tender notification which is issued relates to next year, the writ petition is disposed of directing the authorities to permit the petitioner to supply the material in terms of the agreement.
