This writ petition is filed seeking a direction to respondents not to interfere with the peaceful possession and enjoyment of petitioners over an extent of Ac.0-28 cents in Sy.No.51/7 of Pandilapalli Village, Vetapalem Mandal, Prakasham District.

Learned Assistant Government Pleader produced written instructions stating that revenue authorities have made a search for identification of suitable government land for the purpose of Anganvadi centre building in Pandilapalli Village. Measurements have been taken as a part of identification of suitable government land. It is further stated that land of the petitioners admeasuring Ac.0-28 cents in Sy.No.51/7 was not selected for construction of Anganvadi centre building in Pandilapalli Village. Proposals for construction of Anganvadi centre building in the said site have also not been initiated and submitted to the higher authorities. As far as Revenue Department is concerned, there is no proposal to allot the subject land for construction of Anganvadi centre building as on the date of instructions. If this land is required for any public purpose, it will be taken only after following due process of law. It is also stated that no land including the land in question will be taken by the Government without following due process of law.

In view of the same, the writ petition is disposed of directing the respondents not to dispossess the petitioners from the subject land, without following due process of law.
