HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No:34493 OF 2016 ORDER:

The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, challenging the inaction of the 5th respondent in investigating into Crime No.27 of 2016 and seeking a direction to respondents Nos.2 and 3 to take appropriate action against the 5th respondent.

The main grievance of the petitioner is that on the complaint lodged by his cousin, the above crime was registered by the 5th respondent against Manyam Siva Reddy and others and that the 5th respondent foisted a false case implicating the petitioner, his father and others and registered FIR No.26 of 2016. The petitioner obtained bail in the said Crime and thereafter, the 5th respondent is insisting the petitioner to surrender his passport and Aadhar Card. Further, the 5th respondent is calling him every day to the police station and harassing him. In this connection, even though the petitioner made an oral representation to the Superintendent of Police-3rd respondent, no action was taken. Hence, he approached this Court seeking a direction to the 3rd respondent herein to take appropriate action against the 5th respondent.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case, this Court is of the view that if the petitioner is having any grievance against the 5th respondent in connection with his highhanded action, he has to make a written representation before the 3rd respondent, who is superior authority of the 5th respondent herein. Therefore, the petitioner is directed to make a representation before the 3rd respondent on or before 28th October, 2016

and on such representation being made, the 3rd respondent is directed to dispose of the same, in accordance with law.
