HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 40578 of 2018 ORDER:

1) Heard learned counsel for the petitioner and Sri S.D.Goud, learned Standing Counsel for the second respondent-Municipality. With the consent of both the parties, the writ petition is taken up for hearing at the admission stage.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in trying to evict the petitioner from the leased premises bearing room No.5, Municipal Complex, New Block, Tadipatri Bus Stand, Anantapur City, without following due process of law as illegal and arbitrary.

3) The grievance of the petitioner is that though he is running the shop for the last 25 years, without following due procedure of law the respondents are trying to evict him from the said shop. 4) The learned Standing Counsel for the second respondentMunicipality, on instructions, states that no coercive steps have been taken to evict the petitioner, but however the petitioner is running shop for a period of 25 years, appropriate action will be taken for his eviction.

5) Having regard to the statement made, any action taken by the respondents against the petitioner insofar as the subject property is concerned only in accordance with law.

6) Accordingly, the Writ Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. _________________________ JUSTICE C. PRAVEEN KUMAR 15.11.2018 gkv
