HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.40519 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents 1 to 4 in trying to dispossess the petitioners from their respective house plot Nos.155, 147 and 148, situated at Sy.No.203-2A, Kutagulla, Kadiri Municipal Limits, Ananthapuram District, as illegal and arbitrary.

By an order dated 12.11.2018, this Court while issuing notice directed the petitioners not to carry out any construction of house, compound wall or retaining wall in the subject property, until further orders.

Learned Standing Counsel for the Municipality would submit that no permission has been granted to the petitioners to raise any constructions and constructions made therein are illegal and improper. Learned counsel for the petitioners also states across the Bar that there is no permission for construction of the building. Having regard to the above, the writ petition is disposed of directing the respondent-authorities, to take steps in accordance with law for removal of the illegal constructions said to have been made by the petitioner in the subject premises. Further, the petitioners shall not make any further constructions either with regard to the compound wall or retaining wall in the subject premises. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
