THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 19255 of 2016 ORDER:

Heard learned counsel for the petitioner, Sri Gade Praveen Kumar, learned Standing counsel for Central Government, learned Assistant Solicitor General and learned Government Pleader for Home. With the consent of both parties, the writ petition is disposed of at the admission stage.

Since this Court is not considering the case on merits, it may not be necessary to issue notice to the unofficial respondent. The present writ petition is filed under Article 226 of the Constitution of India, for the following relief:

'To issue an appropriate writ, order or direction more particularly, one in the nature of writ of Mandamus directing respondent No.4 i.e. the Station House Officer, Salur Police Station to execute Non-Bailable Warrant issued by the Hon'ble Judicial First Class Magistrate in C.C.No.221 of 2015 against accused No.1 by finding out the whereabouts from the in-laws and pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice'.

Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to respondent No.3 to consider the representation dated 29.04.2016, made by the petitioner to respondent No.3, as expeditiously as possible. Learned Government Pleader for Home and learned Standing counsel for Central Government submit that if the said representation is still pending consideration, the same shall be dealt with, in accordance with law.

Without going into merits of the case, the writ petition is disposed of directing respondent No.3 to pass orders on representation dated 29.04.2016, made by the petitioner, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy

of the order, in accordance with law, if it is still pending consideration. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. ______________________ JUSTICE C.PRAVEEN KUMAR 17.06.2016, vhb
