HONOURABLE SRI JUSTICE RAJA ELANGO CONTEMPT CASE No.2266 of 2016 ORDER:

This contempt case is filed complaining that the respondent disobeyed the orders dated 17.10.2016 passed by this Court in W.P.No.34797 of 2016.

On 17.10.2016 in the above W.P., this Court passed the following order:

"The petitioners are directed to lodge a complaint before the superior officer of the 4th respondent and on such representation/complaint, the officer concerned is directed to dispose of the said representation/complaint after conducting due enquiry in accordance with law. The 4th respondent is also directed not to interfere with the affairs of the petitioners more particularly, between the affairs of the petitioners and the 6th respondent without there being any specific complaint, which discloses a cognizable offence against the petitioners."

The present contempt case is filed by the 3rd petitioner in the above writ petition.

The respondent filed a counter-affidavit stating that the petitioner and two others are doing Real Estate Business and that several cases are pending against them in respect of land disputes and even the allegations in the complaint of the 6th respondent in the writ petition relate to the land dispute, neither the petitioners nor the 6th respondent in the above Writ Petition filed any complaint before the Deputy Superintendent of Police, CID, Regional Office, Visakhapatnam and that the respondent herein never conducted any investigation or if any, unless the matter has been referred by any other Station House Officers and that the respondent has not violated the orders of this Court.

Considering the facts and circumstances of the case and the averments made in the counter-affidavit, the Contempt Case is closed. No order as to costs.
