Chilakapati Venkata Pushpa v. The State Of Andhra Pradesh
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.35832 of 2017 ORDER:
Petitioner's grievance is that she had applied to the 3rd respondent on 20.03.2017 in Mee-Seva for conduct of survey of her lands by paying requisite fee and that the 3rd respondent has not taken any steps in that regard. 2.
The Government Pleader for Revenue appearing for respondents states on instructions that the land of the petitioner is 'part field' and therefore survey could not be taken up.
3.
Pattadar Passbook had been issued to the petitioner in respect of her land showing that it is agricultural land of extent of Acs.2.00 guntas and 1-B Register, issued by the respondents, corroborates the said fact.
4.
No provision of law has been brought to my notice which states that the land which is treated as "part field" cannot be surveyed.
5.
In this view of the matter, the Writ Petition is disposed of directing the 3rd respondent to immediately take-up survey of the land for which the petitioner has sought demarcation vide application dt.20.03.2017 and complete the same within a
period of six (06) weeks from the date of receipt of a copy of this order. No costs.
6.
Consequently, miscellaneous petitions pending if any shall stand closed.
