HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 0 6 9 5 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Inspector of Police, Aswaraopeta Circle, Bhadradri Kothagudem District, dated 12.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "At the outset, it is respectfully submitted that on coming to know the filing of the Writ Petition by the petitioner herein, this respondent has thoroughly verified the records of this respondent Police Station of Aswaraopet, Bhadradri Kothagudem District, as to whether any complaint has been received or registered against the petitioner herein.
The records revealed that as of now, no complaint whatsoever was received or registered against the petitioner herein on the file of Aswaraopet Police Station, Bhadradri Kothagudem District.
It is pertinent to submit that this respondent enquiries revealed that no prevent the police of Aswaraopet from taking any action in the event of lodging of any complaint against him in future, the petitioners with a malafide intention, without any cause of action, filed the present Writ Petition with false and untenable allegations.
It is submitted that the allegation of the petitioner that even though he got injunction orders from the Hon'ble Court, the unofficial respondents 6 and 7 colluded with each other and influenced this respondent, thereby not entering him into the
WP.40695/2018 AVSS,J subject lands in question is absolutely false, baseless and hence denied.
It is submitted that the allegation of the petitioner that the unofficial respondents approached this respondent and made an oral complaint against him and upon which this respondent called him to the Police Station and as per calling from this respondent, he appeared before this respondent and submitted all the documents pertaining to the land and shown the ad interim injunction order and that this respondent warned him by saying that "civil Courts are passing orders without verifying anything to anybody and commented against the administration of justice" is absolutely false and baseless and more particularly invented for the purpose of filing the Writ Petition and hence the same is denied.
It is submitted that the allegation of the petitioner that even though he sent a legal notice to the higher ups, however, this respondent is not stopping the illegal activities.
It is pertinent to submit that having bore grudge against the unofficial respondents/ defendants in the suit, the petitioner made false and baseless allegations against this respondent.
It is submitted that at any point of time, this respondent never called the petitioner to the Police Station and ask him to shown the documents of the subject lands of the petitioner herein.
It is submitted that it appears that the dispute of the petitioner herein as well as the unofficial respondents herein is purely civil in nature and the petitioner also obtained injunction orders in his favour against the unofficial respondents herein and the matter is subjudice before the Hon'ble Court of Senior Civil Judge at Sathupally in O.S.No.145/ 2018.
WP.40695/2018 AVSS,J It is submitted that this respondent has got highest regard towards the orders passed by the Hon'ble Court and this respondent never commented the orders of the Hon'ble Courts as alleged.
I humbly submit that this respondent never interfered with the civil disputes much les the dispute of the petitioner herein."
Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Inspector of Police, Aswaraopet Circle, Bhadradri Kothagudem District, dated 12.11.2018, with a further direction to the respondent/ police authorities not to interfere with the civil disputes unless the same is permissible in accordance with law.
