HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20625 OF 2016 ORDER:
The grievance of the petitioners is that they have made application for mutation of their names in the revenue records and also for issuance of pattadar pass book and title deed through Mee-seva on 05.02.2016 in respect of the land in Survey No.918/1 to 918/6 of Kotekall Village, Yemmiganur Mandal, Kurnool District and the same was rejected by the 4th respondent by Endorsement dated 31.05.2016, without giving any opportunity of being heard to the petitioners. Aggrieved by the same, present writ petition is filed. Learned counsel for the petitioners submits that before refusing the application submitted by the petitioners for mutation of their names and for issuance of pattedar pass books and title deeds, the petitioners are entitled for notice under Proviso to Section 5(1) of the A.P.
Rights in Land and Pattadar Pass Books Act, 1971 and the respondents bound to give notice while refusing to make entries in the revenue records. Heard learned Assistant Government Pleader for Revenue. A perusal of the impugned endorsement dated 31.05.2016 shows that no notice was issued to the petitioners as envisaged under Section 5(1) of the Act. On the sole ground of violation of principles of natural justice the impugned order is liable to be set aside. In view of the above, the writ petition is disposed of directing the 4th respondent to dispose of the application dated 05.02.2016 made by the petitioner within a period of six weeks from the date of receipt of a copy of this order, in accordance with law after issuing notice to the petitioners as well as to the affected parties. No order as to costs.
As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
