THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.4081 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/A-6 in Crime No.250 of 2015 of Cyber Crime Police Station, Hyderabad, registered for the offences punishable under Section 66 (C) (D) of ITAA 2008 and Section 420 IPC.

Heard the learned counsel for the petitioner/A-6 and the learned Public Prosecutor and perused the material on record. A perusal of the material on record would reveal that since specific overt acts attributable to the petitioner/A-6 have been made in the complaint, prima facie, a case is made out against him. Whether the allegations in the complaint are true or not is a matter to be decided by the investigating agency and the same cannot be decided by this Court at this stage. However, while arguing for some time, the learned counsel for the petitioner stated the other accused in the present crime were released on bail. Having regard to the facts and circumstances of the case and in view of the nature of the offences alleged against the petitioner herein, the petitioner/A-6 is at liberty to approach the competent Court and obtain bail, if he is so advised. With the above observation, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
