SMT JUSTICE T.RAJANI CRIMINAL PETITION No.11968 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused, in Crime No.49 of 2018 on the file of the Station House Officer, Tirumala I Town Police Station, Tirupathi Urban, Chittoor District.

The offence alleged is under Section 420 of I.P.C. 3.

Heard learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.

Learned counsel for the petitioner submits that the allegation against the petitioner is that he collected an amount of Rs.3,000/- for arranging Suprabhata Seva ticket, which is far in excess of the price of the ticket, which is only Rs.120/-. Learned counsel further submits that apart from arranging the aforesaid ticket, the petitioner also arranged accommodation for the complainant and that the same is reflected in the complaint.

But, a perusal of the complaint does not anywhere show that accommodation was also arranged by the petitioner. There is clear allegation that he collected an amount of Rs.3,000/- and that Rs.2,880/- is in excess of the actual ticket amount.

Hence, considering the above, this Court opines that this is not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner/accused is directed to surrender the before the lower Court and obtain regular bail. The lower Court shall dispose of the bail application, if

Accordingly, with the above observation, the Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
