THE HONOURABLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.11972 of 2018 ORDER :

The petitioners are A.1 to A.4 of Crime No.46 of 2018 of Women Police Station, Warangal Commissionrate, it is out come of the report of the de facto complainant/respondent No.2 against them, dated 29.10.2018, registered for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. The petitioners/A.1 to A.4 are seeking to quash the said proceedings. 2.

The sum and substance of the accusation in the F.I.R. in registration of the crime reads that the de facto complainant Shirisha Ajmeera W/o.Gurunanak Ajmeera (A.1), from their marriage performed on 10.06.2017 at Tukya Thanda, Parvathagiri Mandal, Warangal Rural. At the time of marriage, the accused persons, A.1 husband, A.2 mother-in-law, A.3 sister-in-law and A.4 brother of A.1, as per their demand, taken Rs.2,50,000/- cash and another Rs.90,000/- cash for bike and 17 1⁄2 tolas of gold jewellary. Further as per their demand there is a house plot at Akula Thanda of Ac.0.08 gts. given. A.1 was allegedly having a job and drawing more than Rs.30,000/- per month as per the false pretences by accused persons prior to the marriage of the de facto complainant with A.1. However, after the marriage from that promise acted upon it came to light that he was not doing any job and accordingly they were cheated and after marriage she joined her husband at in-laws house at Tukya Thanda and the

Dr.SSRB, J Crl.P.No.11972 of 2018 marital life for five months went smoothly and as A.1 was not doing any job and sitting idle by keeping that in mind from her questioning all the accused started harassing including to bring additional dowry of Rs.8 lakhs from her parents and to sell Ac.0.08 gts. house plot and bring the money and she was ill-treated and harassed physically and mentally by all accused. The matter went before the elders where they assured to treat her well and A.

1 assured to secure some job and in search for it and taken her back and when she was carrying he left her at the in-laws house and went to Hyderabad in search of job and not even telephoning to her nor enquiring her welfare and the other accused used to treat her as a slave by made her to attend entire house hold work without even properly providing food and ill-treating mentally and physically and on knowing the same in fate of her by her parents she was brought to her parents house in May 2018 and there was abortion of her and she is at the mercy of her parents, as accused not allowing her to join her husband and A.1 not taking her with a demand to meet additional dowry of Rs.8 lakhs, hence to take action. 3.

So far as A.4 address concerned, it is mentioned as student, Parvathinagar, Warangal, and A.3 working as A.E.O. in Agricultural Department at Thorrur of Mahabubnagar District. It is only the de facto complainant mainly lived at the in-laws i.e., mother-in-law and husband and husband's brother also as referred supra staying there. However, there are no any specific allegations against A.3 and A.4, but for mainly against A.1 and A.2

Having regard to the above, the criminal petition is allowed in part by quashing the proceedings so far as against A.3 and A.4, by continuing against A.1 and A.2. However, it will not prevent the police from the investigation if at all there is any material to include any of them. The bail bonds of the A.3 and A.4, if any, shall stand cancelled.
