HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43612 of 2016 ORDER:

This writ petition is filed seeking to declare the registration of FIR No.372 of 2016, dated 29.11.2016, as illegal and arbitrary and to set aside the same.

Heard and perused the material available on record. The case of the petitioners is that the 3rd respondent lodged the present complaint against the petitioners alleging that the marriage between the 1st petitioner and 3rd respondent was performed on 30.11.2011 and at the time of marriage, her parents gave an amount of Rs.2,00,000/- and 3 tulas of gold and other things and that they lived happily for about two years and later the 1st petitioner started harassing the 3rd respondent physically and mentally for additional dowry and that the 1st petitioner married 2nd petitioner without the consent of the 3rd respondent and that on 15.11.2016, the 2nd petitioner along with her parents and her relatives came to the house of the 3rd respondent and all of them beat her with hands and legs and sticks and harassed her for additional dowry.

Basing on the said complaint, the 2nd respondent registered the same as FIR No.372 of 2016 for the offences under Sections 498-A, 494 & 324 IPC and Sections 3 & 4 of the Dowry Prohibition Act. The main grievance of the petitioners is that basing on the said case, the 2nd respondent is threatening to arrest the petitioners.

Considering the grievance of the petitioners, the 2nd respondent is directed to complete the investigation in FIR No.372 of 2016, as expeditiously as possible and file a final report, if any,

either way in accordance with law, without arresting the petitioners.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
