The Hon'ble Dr.Justice Shameem Akther Criminal Petition No.10692 of 2017 Order:
This Criminal Petition, under Section 438 of Cr.P.C., is filed by the petitioner/accused, seeking anticipatory bail in the event of his arrest in connection with Crime No.303 of 2017, on the file of Devarakonda Police Station, Nalgonda District, registered for the offence punishable under Section 354 IPC.
Heard the learned Counsel for the petitioner, learned Additional Public Prosecutor appearing for the respondentState and perused the record. The learned Counsel for the petitioner/accused would submit that the petitioner is falsely implicated in this case and that no incident, as alleged in the First Information Report, had taken place. He, ultimately, prayed to allow this Criminal Petition.
The learned Public Prosecutor opposed for grant of anticipatory bail to the petitioner.
Dr.SA, J Crl.P.No.10692 of 2017 Dt: 13-11-2017 The allegation levelled against the petitioner is that on 03-08-2017, at about 6.30 p.m., when the petitioner, who was a bus conductor, was returning to her house after depositing the cash with the concerned, the petitioner followed her, caught hold of her, with an intent to use criminal force and outrage her modesty to fulfill his sexual desire, dragged her cell phone and pelted the same on the ground. On an earlier occasion also, the petitioner did similar activities such as touching the body of the defacto-complainant etc. Despite warning several times, the petitioner did not change his behaviour and ultimately, he indulged in the alleged aforesaid act. On a report given by the defacto-complainant, the present complaint has been registered against the petitioner. The alleged monitory transaction has nothing to do with the allegations.
As the allegations are grave in nature, the petitioner cannot be granted anticipatory bail.
