Gaddam Venkaiah v. The State Of Telangana
THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.40614 of 2018 ORDER:
Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material available on record.
When the matter is taken up, written instructions, dated 22.11.2018, furnished by the Sub Inspector of Police, Chandur Police Station, Nalgonda District, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, are as under:
"The petitioner herein has approached the Police of Chandur Police Station, Nalgonda District and lodged a complaint on 16.9.2018 stating that he has 4 plots in Sy.No.110 situated at outskirts of Gattuppal village and he has constructed the house in one plot and the petitioner and his family members are residing therein and that one Mr. Kakkunuri Ramu is threatening the people that he is the informer of the police and that the said Ramu and his father Kakunuri Pullaiah threatened the petitioner by saying that to go out from the plot and that on 10.5.2017, 10.3.2018 20.4.2018 they also attacked on him and illegally trespassed into his plot and threatened that they would kill him and hence requested the police to take necessary action as per law.
Upon receipt of the said complaint, an entry was made into the Station General Diary, after enquiry action will be taken.
In the preliminary enquiry, it is revealed that the dispute of the petitioner herein as well as the 5th and 6th respondents herein who is son and father is purely civil in nature and they are claiming rights and title over the subject plot of the petitioner herein and hence no action was taken except informing the petitioner to approach the competent court of law.
It is pertinent to submit that since the dispute of the petitioner as well as the unofficial respondents herein is purely civil in nature and the petitioner unnecessarily trying to involve this respondent police into his personal and civil disputes. Therefore, this respondent police has not taken any action. The said fact was also informed to the petitioner by way of issuance of notice dated 19.11.2018 which was sent by Regd. Post on 22.11.2018".
Eventually a request is made by the learned counsel for the petitioner to dispose of the Writ Petition by placing on record the above instructions.
Accordingly, by placing on record the above written instructions, this Writ Petition is disposed of. However, it is open for the petitioner herein to avail the other remedies in accordance with law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
