THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9792 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1, 2 and 10 under Sections 437 and 439 Cr.P.C. seeking to grant bail to them in Crime No.91 of 2016 on the file of Muthukur Police Station, Nellore, Andhra Pradesh, registered for the offences punishable under Sections 427 and 379 IPC.

Heard and perused the material available on record. It is alleged that the petitioners and other accused committed theft of huge quantity of oil worth Rs.60 lakhs from a pipeline. Learned Counsel for the petitioners submitted that the petitioners never committed any offence and they were falsely implicated in the above crime and that they were arrested on 11.5.2016 and since then, they have been in prison. Learned Additional Public Prosecutor, while opposing this petition, submitted that in this case, many persons are involved and huge quantity of oil was stolen and that the investigation is in progress. Considering the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor, this Court is not inclined to grant bail to the petitioners at this stage.
