HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.40665 of 2018 ORDER:
It is the case of the petitioners that they are absolute owners and possessors of land in sy.No.769 admeasuring Ac.15-39 guntas situated at Janwada Village, Shankarpally Mandal, Ranga Reddy District. That unofficial respondents 4 to 7 obtained revenue proceeding and the same was challenged by the petitioners before the Joint Collector, Ranga Reddy District. That the Joint Collector disposed of the matter directing the petitioners to work out remedies under civil law. On that the petitioners filed O.S.No.23 of 2016 for declaration and recovery of possession on the file of XII Additional District Judge at Vikarabad and the same is pending. It is further case of the petitioners that respondents are trying to make an application to conduct survey and demarcation of subject land.
On that the petitioners made a representation to the 3rd respondent for not to conduct survey of subject land, in view of pendency of civil suit. So far no action has been taken by respondent No.3 on the representation of the petitioners. Having regard to the above, if the petitioners are aggrieved by the action of respondents, they can obtain appropriate orders in the civil suit filed by them, instead of filing the writ petition. The petitioners cannot maintain two parallel remedies simultaneously.
In view of the same, the writ petition is disposed of granting liberty to the petitioners to avail alternative remedies
available to them under law. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
