2017-11-02M.S.Ramachandra Rao2 pages

THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.36360 of 2017 ORDER:

Heard counsel for petitioner and the Government Pleader for Revenue appearing for respondents.

2.

Petitioner contends that respondents 4 and 5 are insisting on a 'No Objection Certificate' for the purpose of registering the property.

3.

The Government Pleader for Revenue appearing for respondents states that the subject land is included in the Notification issued under Section 22A(1)(a) of the Registration Act, 1908 and that if the petitioner is aggrieved, he must approach the Committee appointed, as directed by a Full Bench of this Court in its order dt.23.12.2015 in W.A.No.343 of 2015.

4.

It is not in dispute that against the said decision, special leave applications in Petition(s) for Special Leave to Appeal (C)... CC.No.20870 of 2016 and batch have been filed before the Supreme Court and on 15.11.2016 while granting leave, the Supreme Court made it clear that registration may go on, expressly making it subject to the final out come of the said Special Leave Petitions.

5.

In this view of the matter, respondents 4 and 5 are directed to register the documents presented by the petitioner, making it clear that it would be subject to the final outcome of the Petition(s) for Special Leave to Appeal (C)... CC.No.20870 of 2016 and batch.

6.

Accordingly, the Writ Petition is allowed. No costs. 7.

Miscellaneous petitions, pending if any, shall stand closed.
