This Writ Petition is filed for the following relief: "to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents 3 to 5 herein to consider the petitioner's name to be appointed as Anganwadi worker by following the memos dated 23.12.1998, 03.12.2010 and 05.01.2012 issued by the respondents 1 & 2 as being illegal arbitrary and violative of rights guaranteed under Article 14, 16 and 21 of Constitution of India and as per the law laid down in WP.No.313744 of 2015 and batch dated 16.11.2015 and further declare that the writ petitioner is entitled to be appointed as Anganwadi worker and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Women and Child Welfare produced written instructions stating that petitioner is not residing in the same village and she is not attending the duties.

The fact remains that as on today, petitioner is working as Anganwadi Helper. If any allegations are there against the petitioner, it is open for the respondents to take action. But, as long as she is working as Anganwadi Helper, her case has to be considered for appointment/promotion in terms of the Judgment dated 16.11.2015 in WP.No.31374 of 2015 and

batch, in accordance with Rules, subject to eligibility and suitability.

With the above direction, the writ petition is disposed of. No order as to costs.
