ORDER
This writ petition is filed seeking to declare the action of the respondents in issuing G.O.Rt.No.72, dated 1.2.2017 proposing to lay BT road from Parlapadu to Vellala of Rajupalem Mandal, Kadapa District, through the lands of the petitioners without following due procedure contemplated under the Land Acquisition Act, 1894, as arbitrary and illegal. The grievance of the petitioners is that though there are two roads existing from Parlapadu to Vellala of Rajupalem Mandal, Kadapa District, the respondents are laying another road through their lands.
Learned Government Pleader for Panchayat Raj appearing for respondents 1 to 3 submits that the proposed road is not passing through the lands of the petitioners. In the para-wise remarks submitted by the learned Government Pleader, it is stated that the road sanctioned by the Panchayat Raj Department is very shortest route and benefits nearly 200 village farmers. It is further stated that already a Government cart track is existing adjoining the petitioners lands and the same is useful to the villagers of Parlapadu Village.
In view of the same, the Writ Petition is disposed of directing the respondents not to interfere with the lands of the petitioners without following due process of law, but, however, the respondents are at liberty to go ahead with the process of laying road, in the existing cart track as per village map.
