Heard learned counsel for the petitioner and Sri Chimalapati Ravi, learned Standing Counsel for the 5th respondent.
Admittedly, petitioner has alternate remedy of appeal against the impugned order. It is not the case of the petitioner that impugned order passed by the 4th respondent is without jurisdiction, as such, petitioner can prefer appeal against impugned order. In view of above, it is open for the petitioner to prefer appeal against the impugned order, within a period of four weeks from the date of receipt of a copy of this order. Thereafter, the competent authority is directed to dispose of the same, within a period of four weeks thereafter. Till then, there shall be stay of recovery of an amount of Rs.7,14,124/-. If the petitioner fails to file appeal within the stipulated period, it is open for the respondents to take action in accordance with law.
However, this will not preclude the competent authority from initiating action for recovery of the said amount. With the above direction, writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.
