THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.2875 of 2016 ORDER:
Aggrieved by the award passed by the third respondent in favour of the fourth respondent in ARC.No.679 of 2014 dated 23.12.2014, the petitioners have filed the present Writ Petition.
The impugned award is passed under the Chit Fund Act, 1982 (for short 'the Act'). Under Section 70 of the Act, appeal lies to the State Government, and this Court already adjudicated upon the powers of the appellate authority under the Act. Hence, there is no reason why, the petitioners should not be relegated to the remedy of appeal.
Accordingly, the Writ Petition is disposed of giving liberty to the petitioners to avail the remedy of appeal in accordance with law. Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. No order as to costs.
