HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.39402 OF 2017 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the respondent authorities in entering the lands owned by the petitioner in R.S.No.250/1, R.S.No.253/6, R.S.No.251/4, total to an extent of Ac.1.49 cents, situated at Vanapalli Village, Kothapeta Mandal, East Godavari District for putting the stones to lay the road, without acquiring the said lands, as illegal and arbitrary and for a consequential direction to the respondents authorities not to enter the lands of the petitioner without acquiring the same, while making it clear that the respondents shall not interfere with the agricultural lands of the petitioner without acquiring them.

Heard learned counsel for the petitioner.

Sri Ravi Cheemalapati, learned Standing Counsel for the 3rd respondent-Zilla Parishad basing on written instructions submits that the Zilla Parishad is not laying any road and that laying of said road is vested with the Road Buildings Department. Recording the aforesaid submission of the learned counsel, writ petition is disposed of. However, it is open for the petitioner to file fresh writ petition by impleading proper parties. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
