The grievance of the petitioner is that the respondents are not conducting open auction or handing over to any eligible co-operative society in respect of four tanks namely;- Phakiraiah Cheruvu, Devalla Cheruvu, Bommakunta Cheruvu and Voora Cheruvu of 1426 Fasli situated in Vegendla Gram Panchayat. Aggrieved by the same, the present writ petition is filed.

Sri G.Seshadri, learned Standing Counsel for Gram Panchayat submits that the 8th respondent-Panchayat Secretary has sent proposal to the 4th respondent on 22-07-2017 for fixation of upset price in respect of said tanks for conducting auction. As and when upset price is fixed by the 4th respondent and if the same is intimated to the 8th respondent, auction will be conducted.

In view of the same, the 4th respondent is directed to consider the proposals sent by the 8th respondent on 22-07-2017 for fixation of upset price and take action within a period of two weeks from the date of receipt of a copy of this order and intimate the same to the 8th respondent and on such information, the 8th respondent is directed to conduct auction for grant of fishing rights in respect of four tanks in accordance with law within a period of four weeks thereafter.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 04-12-2017 Nvl
