CMA.No. 189 OF 2016 J U D G M E N T : {Per the Hon'ble Sri Justice Suresh Kumar Kait} Sri Nimmagadda Satyanarayana, learned counsel for the appellant filed a letter dated 15/2/2017 before the Registry stating that the above CMA was filed, assailing the order and decree dated 26/11/2015 passed by the Senior Civil Judge, Razole, East Godavari district in OP.No. 7 of 2014. After filing the above CMA both parties have settled the dispute and compromised the matter between them and requested not to press the above appeal.

2. When the matter is listed today, learned counsel sought permission of this Court to withdraw the above appeal.

3. Permission is accorded.

4. Recording the above submission, this Civil Miscellaneous Appeal is accordingly dismissed as withdrawn. No order as to costs.
