HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No. 5189 of 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard leaned counsel for the petitioner.
In the instant writ petition, the petitioner, who claims to be the Vice-Sarpanch of Satyavedu Village, Chittoor District, seeks the following relief:
"For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate writ, order, direction more particularly one in the nature of writ of mandamus declaring the action of the 5th respondent in awarding and permitting the 8th respondent to carry on the work excavating canal spoil vide proceedings No.SE/TGP&GNSS.C/TPT/DB/ATO/34SE/2015-16 dated 11.01.2016 in violation of G.O.Ms.No.2, dated 03.02.2014, as being illegal, arbitrary, violative of Articles 14, 19 and 21 of the Constitution of India and to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case." Admittedly, work was allotted on 11.01.2016. Learned counsel for the petitioner, in response to our specific query, submits that 50% of the work has already been completed. Total cost of the work is about Rs.4,00,000/-.
Keeping that in view, we are not inclined to interfere with the decision to award work to respondent No.8.
Hence, the writ petition is dismissed.
Consequently, miscellaneous petitions, if any, also stand disposed of.
