HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 36225 of 2017 Order:

The petitioner was appointed as Field Assistant in Dimilada Gram Panchayat, Nandigam Mandal, Srikakulam District, under Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGS), by the Mandal Parishad Development Officer on 22.03.2010. While so, a show cause notice was issued on 23.02.2015 by the fourth respondent asking the petitioner to submit his written explanation to the said show cause notice. It was alleged in the show cause notice that the petitioner was not attending to his duties without prior permission, not providing work to the wage seekers and not providing work to 23 groups. The petitioner could not submit his explanation due to ill-health, but the fourth respondent issued proceedings on 06.04.2015 removing him from the said post.

Against the said order, the petitioner filed an appeal before the third respondent and though a notice was issued on 10.02.2016 asking the petitioner to appear in person for personal hearing with written explanation and the petitioner appeared and submitted his explanation on 04.03.2016, when no orders were passed, the present Writ Petition is filed.

Learned Standing Counsel for the respondents 3 and 4 submits that the appeal is still pending and orders are yet to be passed. In view of the same, the third respondent is directed to pass appropriate orders on the appeal filed by the petitioner against the order dated 06.04.2015 within a period of four (4) weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
