THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.40535 OF 2016 ORDER :

The petitioner union raised conciliation proceedings against illegal termination of contract workmen who are stated to have been working for more than 25 years. Conciliation proceedings were initiated by the 3rd respondent on 30.06.2016. Alleging deliberate inaction of the proceedings initiated causing grave hardship and suffering and affecting their fundamental rights, this writ petition is filed.

Heard learned counsel for the petitioner and learned Standing counsel for respondents 1 and 3 and learned counsel for the respondent No.5.

Learned counsel for the petitioner contends that in terms of the provision contained in Section 12 (6) of the Industrial Disputes Act, the conciliation proceedings should be completed within 14 days. Whereas, for more than 6 months, proceedings are pending and so far they are not concluded.

On instructions, learned Standing counsel representing respondents 1 and 3 submits that the 3rd respondent shall conduct and conclude the conciliation proceedings within one month from today. Learned counsel representing respondents 4 and 5 also agree for conclusion of the conciliation proceedings by the 3rd respondent.

Having regard to the said submissions, the Writ Petition is disposed of, recording the said statement on behalf of respondents

1 and 3 that the conciliation proceedings would be concluded within 30 days from today. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
