HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE M.GANGA RAO Writ Petition No.38194 of 2017 Order: (per V.Ramasubramanian, J.) Aggrieved by the dismissal of his application seeking compassionate appointment, the unsuccessful applicant before the Tribunal has come up with the above writ petition.

2. Heard Mr. D.Linga Rao, learned counsel for the petitioner.

3. The petitioner's father died in harness on 16-7-2011. The petitioner made an application for appointment on compassionate grounds, in August, 2011. Admittedly, at the time of making the application, the petitioner was aged 41 years and 2 months.

4. Therefore, he was not eligible for appointment on compassionate grounds, as a person of such an age he could not be presumed to have been left in the lurch by the sudden demise of his father. As a matter of fact, the petitioner belongs to the Backward Classes. For Backward Classes, the upper age limit including the number of years of relaxation was 39 years. Unfortunately, the petitioner had crossed 39 years at the time of making the application.

5. Therefore, the rejection of the application filed by the petitioner was in order. We see no reason to interfere with the order of the Tribunal. Hence, the writ petition is dismissed.

The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
